Heath told the club about it when it happened, Colin didn't inform his club. Hard for a club to look out for their player when he keeps it "secret".

You started going on about PR, and I said maybe the reason was that Scotland was sensible and went to the club first.

I personally think it's silly of him to get involved in an incident that sees him wind up in court, but without any details on what occurred I can't make judgement.
