I don't know the law of Freedom of Information that well - but that might be worth trying. I only did some in admin law (which was dead boring) - and I can't remember any of it.

Spread a fake quote to the media which damns 1 person (or more) forcing the publication of the 'real' document?

I take it that the feeling is no one will walk and that Smorgon continues to believe that he can ride this out up to and including the election?

I was under the impression that the Board didn't see a full copy of the report, that the AFL gave Malouf the 'highlights', which he presented to the Board. There was definitely an article in the paper at the time which said that Malouf presented the Board with the highlights of the report.

So...either that was all he was given, or...he got a full copy, and only presented certain parts (not surprising, if the rumours that it was scathing of his performance are true) to the Board.

Does anyone know more of this?

I thought the AFL gave Malouf the full report and then he selected which bits would be shown to the rest of the board

For sure.

Even if it is highlights, it would give us a better. understanding of just how incompetent our board really is.

Well, if that's the case, then that is a joke. The report (supposedly) slams the CEO and the President, and they are the only two people to see it? What are they going to do, publicise the whole thing to the rest of the Board/members so that everyone else can see that they have been assessed as incompetent? So Malouf presents selected elements, and conveniently leaves out the rest of the damning content.

Where is the accountability here?

I agree with others, if it is decided that it is best to get this public, Caro is the man...so to speak. Or maybe Jim Wilson, but he has been suspiciously quiet of late, I'm wondering if he might have some involvement in a challenge.

On the flip side, if there is a challenge brewing, surely they would have considered all this?

You probably should be able to get it under FOI laws, if you can prove you have a legitimate reason (i'm not a lawyer). I would have thought being a financial, voting-rights member would qualify you...

Having said that, FOI requests can take months or longer, and I don't reckon we've got that much time for regime change...

Maybe contact Bush, Rumsfield and Wolfowitz instead...

The FOI route is not likely to apply because the Carlton Football Club is not a governmental agency.

Now I have not practised law in Australia for over 5 years and in any event my specialization was never matters of corporate governance, but I would think the only way to get the report is to find a ground in the Corporations Law that one or both is not fit to be an officer of the Club and attempt to obtain the document through discovery. The document is not likely to be privileged but others may have more insight in the discovery rules in Australia. The problem is that this is likely to be a drawn out process. There is however means in Australia to make an application for preliminary discovery -- ie, obtain the report before formally commencing action -- to see whether there are grounds to bring a formal action.

Ummmmmmmm but we can demand it and the club and the AFL would have to deny us looking at a report that assesses how this club and its administrators are performing on behalf of the membership???

I think people may be getting carried away here with FOI. Such a commercial in confidence document would not fall under the provisions.
If anyone has strong connections to a board member, I would suggest they enlist their support to gain access to such a report in its entirety. I can't see their request being declined given their role in the club.

Dang - I knew I didn't pay attention in Admin Law LOL

If a lawsuit is filed, then you could subpoena the document or as fjanyc said, try it in discovery. It'd probably be a Corporations Act case - about directors' duties - but can't think of any sections off the top of my head.
